1. GENERAL INFORMATION

This document (as well as any other document mentioned herein) regulates the conditions governing the use of this Website (outlet-pc.es) and the purchase or acquisition of products and/or services through it (hereinafter referred to as the "Conditions").

For the purposes of these Conditions, it is understood that the activity carried out by OUTLET PC through the Website includes:

  • Sale of computer products, household appliances, and/or kitchen appliances.

By simply accessing the website, the user is considered a user of the Website.

In addition to reading these Conditions, before accessing, browsing, and/or using this website, the user must have read the Legal Notice, including the cookie policy, and the privacy and data protection policy of OUTLET PC. By using this Website or making a purchase or acquisition of a product and/or service through it, the user consents to be bound by these Conditions and by all the aforementioned policies. If the user does not agree with any of these, they should not use this Website.

Furthermore, please note that these Conditions may be modified. It is the user's responsibility to review them each time they access, browse, and/or use the Website, as the applicable Conditions will be those in effect at the time of purchasing products and/or services.

For any questions the user may have regarding the Conditions, they can contact the owner using the contact information provided above or by using the contact form, if available.

The contents of the outlet-pc.es website may, on occasion, display provisional information about certain offers, services, or products. If the information provided does not correspond to the characteristics of the product, the customer will have the right to cancel their purchase at no cost.

2. THE USER

By accessing, browsing, and using the Website, the user acquires the status of user (hereinafter referred to, interchangeably, individually as "User" or collectively as "Users"), thereby accepting all the Conditions set forth herein, as well as their subsequent modifications, without prejudice to the application of the corresponding legally binding regulations, as applicable.

The user is responsible for using the Website correctly. This responsibility extends to:

  • Using this Website solely to make legally valid inquiries, purchases, or acquisitions.
  • Not making any false or fraudulent purchases. If it could reasonably be considered that such a purchase has been made, it may be canceled and reported to the relevant authorities.
  • Providing accurate and lawful contact information, such as email address, postal address, and/or other details (see Legal Notice and General Terms of Use).

The user declares to be of legal age and to have the legal capacity to enter into contracts through this Website. The user understands that, for security reasons, we may unilaterally reject their order. This will be the case for orders placed with cards from outside the EU or that have not undergone a 3Ds validation flow.

The Website is aimed at end consumer Users. OUTLET PC will not provide service to its competition: reseller companies, resellers, dropshippers, or any entity that competes in any segment with Outlet PC. OUTLET PC does not guarantee that the Website complies with the legislation of other countries, whether in whole or in part. OUTLET PC disclaims all liability that may arise from such access and does not guarantee shipments or the provision of services outside of Spain.

The user may formalize, at their choice, with OUTLET PC the contract for the sale of the desired products and/or services in any of the languages in which these Conditions are available on this Website.

OUTLET PC reserves the right to accept purchases to protect the integrity of its services and ensure a positive experience for all users. In this regard, it reserves the right to block the account of those users who present a very high percentage of open incidents related to their purchases.

The user may request a review of their case by submitting the necessary documentation or arguments to reconsider the decision. OUTLET PC undertakes to review the user's request and provide a resolution within 10 business days.

The user's account may be reactivated if, after review, it is determined that the open incidents are not attributable to misuse of the service by the user or if the incidents have been satisfactorily resolved.

3. PURCHASE OR ACQUISITION PROCESS

Registered users can make purchases on the Website using the established means and methods. They must follow the online purchasing and/or acquisition procedure on outlet-pc.es, during which various products and/or services can be selected and added to the cart or final purchase space, and finally click on "CHECKOUT."

The user must fill in and/or verify the information requested at each step, although the purchase data can be modified during the purchase process before making the payment.

Subsequently, the user will receive an email, at the address provided at the time of purchase, confirming that OUTLET PC has received their order or purchase request and/or service provision, i.e., the order confirmation. Likewise, the user will be informed of the status of their order when it has been shipped. This information may also be made available to the user through their personal account on the Website.

Once the purchase process is complete, the user consents to the Website generating an electronic invoice, which will be sent to the user via email and, if desired, through their personal account on the Website. The user may also request a paper copy of their invoice by contacting OUTLET PC using the contact information provided above or through the available contact spaces on the Website.

The user acknowledges that, at the time of purchase, they are aware of certain specific sales conditions regarding the product and/or service in question, which are displayed alongside the product presentation or image on its page on the Website. These conditions include, but are not limited to, the product's name, price, components, weight, quantity, color, product details, characteristics, method of execution and/or cost of services. By placing the purchase order or making the acquisition, the user fully and completely accepts the specific sales conditions applicable in each case.

Communications, purchase orders, and payments made during transactions on the Website may be archived and stored in OUTLET PC's computer records, serving as a means of proof of the transactions. This will be done in compliance with reasonable security conditions and the applicable laws and regulations, particularly considering Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), and the rights that Users have in accordance with the privacy policy of this Website.

4. AVAILABILITY

All purchase orders received by OUTLET PC through the Website are subject to product availability and to the absence of any circumstances or force majeure events (clause nine of these Terms) that may affect the supply of the products and/or the provision of services. If there are difficulties in the supply of products or if products are out of stock, OUTLET PC undertakes to contact the User and refund any amount that may have been paid as a payment. This will also apply in cases where the provision of a service becomes impracticable.

5. PRICES AND PAYMENT

The prices displayed on the Website are final, in Euros (€), and include taxes, unless otherwise required by law, especially regarding VAT, and a different provision is indicated and applied.

Shipping costs are not included in the final prices of the products, but will be added to the order cost when selecting a delivery method. Thus, OUTLET PC provides delivery and/or shipping services through Correos Express and MRW.

In no case will the Website add additional costs to the price of a product or service automatically, but only those that the user has voluntarily and freely selected and chosen.

Prices may change at any time, but such changes will not affect orders or purchases for which the user has already received an order confirmation.

The accepted payment methods will be: credit or debit card, bank transfer, and occasionally, financing with Cetelem (subject to approval).

OUTLET PC uses all means to guarantee the confidentiality and security of payment data transmitted by the user during transactions through the Website. As such, the Website uses a secure SSL (Secure Socket Layer) payment system.

Credit cards will be subject to verification and authorization by the issuing bank. If the bank does not authorize the payment, OUTLET PC will not be responsible for any delay or failure of delivery and will not be able to formalize any contract with the user.

Once OUTLET PC receives the purchase order from the user through the Website, a pre-authorization will be made on the corresponding card to ensure that there are sufficient funds to complete the transaction. The charge on the card will be made at the time the User receives the shipping confirmation and/or confirmation of the service provided, as appropriate.

6. DELIVERY

In cases where physical delivery of the contracted goods is required, deliveries will be made within the following territory: Spain (Peninsula and Balearic Islands).

Except in cases of unforeseen or extraordinary circumstances or, where applicable, derived from the customization of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the timeframe indicated on the Website, according to the selected shipping method by the user, and in any case, within a maximum period of 30 calendar days from the date of the order confirmation.

If, for any reason attributable to OUTLET PC, it is unable to meet the delivery date, OUTLET PC will contact the User to inform them of this circumstance, and the User may choose to proceed with the purchase by establishing a new delivery date or cancel the order with a full refund of the price paid. In any case, home deliveries are made on working days.

If it is impossible to deliver the order due to the absence of the user, the order may be returned to the warehouse. However, the carrier will leave a notice explaining where the order is and how to arrange for it to be delivered again.

If the user will not be present at the delivery location during the agreed time slot, they must contact OUTLET PC to arrange delivery for another day.

In the event that 30 days have passed since the order is available for delivery and it has not been delivered due to reasons not attributable to OUTLET PC, it will be understood that the user wishes to terminate the contract, and it will be considered resolved. As a result of the resolution of the contract, all payments received from the user will be refunded, except for any additional expenses resulting from the user's choice of a delivery method different from the least costly ordinary delivery method offered by the Website, without undue delay and, in any case, within a maximum period of 14 calendar days from the date the contract is considered resolved.

However, the user should be aware that the transportation resulting from the resolution may have an additional cost that may be charged to them.

For the purposes of these Terms, it will be understood that delivery has occurred or the order has been delivered at the moment when the user or a third party indicated by the user acquires physical possession of the products, which will be evidenced by signing the receipt of the order at the agreed delivery address.

The risks associated with the products shall be borne by the user from the moment of delivery. The user acquires ownership of the products when OUTLET PC receives full payment of all amounts due in relation to the purchase or acquisition, including shipping costs, or at the time of delivery, if it occurs after the complete receipt of the payment amount by OUTLET PC.

In accordance with the provisions of Law 37/1992, of December 28, on Value Added Tax (VAT), purchase orders for delivery and/or provision will be deemed to be located within the territory of Spanish VAT if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one legally in force at any given time depending on the specific article concerned.

7. TECHNICAL MEANS TO CORRECT ERRORS

The user is informed that in the event of detecting an error when entering data necessary to process their purchase request on the Website, they may modify it by contacting OUTLET PC through the contact spaces provided on the Website and, if applicable, through those provided to contact customer service, and/or by using the contact details provided in clause one (General Information). Likewise, this information can also be corrected by the user through their personal account on the Website.

In any case, before clicking on "PAY NOW," the user has access to the space, shopping cart, or basket where their purchase requests are recorded and can make modifications.

Likewise, the user is referred to consult the Legal Notice and General Sales Conditions, and specifically the Privacy Policy, for more information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data (GDPR), and in Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

8. RETURNS

In cases where the user purchases products on or through the website of the company, they have certain rights, as listed and described below:

Right of Withdrawal

As a consumer and user, the user makes a purchase on the website and, therefore, has the right to withdraw from the purchase within a period of 14 calendar days without justification.

This withdrawal period will expire 14 calendar days from the day the user or a third party authorized by the user, other than the carrier, acquires physical possession of the goods purchased on the OUTLET PC website, or in the case of goods that make up the order being delivered separately, 14 calendar days from the day the user or a third party authorized by the user, other than the carrier, acquires physical possession of the last of those goods that make up the same purchase order, or in the case of a service contract, 14 calendar days from the day of the conclusion of the contract.

To exercise the right of withdrawal, the user must notify OUTLET PC of their decision by initiating an incident from their profile on the website or by using the provided withdrawal form.

Regardless of the means chosen to communicate the decision, the user must clearly and unequivocally express their intention to withdraw from the purchase contract. In any case, the user may use the withdrawal form template provided by OUTLET PC, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for the communication expressing the unequivocal decision to withdraw to be sent before the corresponding deadline expires.

In the event of withdrawal, OUTLET PC will refund the User all payments received, including shipping costs (with the exception of any additional costs resulting from the user's choice of a shipping method different from the least costly method offered on the website), without undue delay and, in any case, no later than 14 calendar days from the date OUTLET PC is informed of the user's decision to withdraw.

OUTLET PC will make the refund using the same means of payment used by the user for the initial purchase transaction. This refund will not generate any additional costs for the user. However, OUTLET PC may withhold the refund until the products or items of the purchase are received, or until the user provides proof of return, depending on which condition is met first.

The user must do so without undue delay and, in any case, no later than 14 calendar days from the date OUTLET PC was informed of the decision to withdraw.

The user acknowledges that they shall bear the direct cost of returning the goods, if applicable. Additionally, the user shall be responsible for any diminished value of the products resulting from handling them beyond what is necessary to establish their nature, characteristics, and functioning.

The user acknowledges that there are exceptions to the right of withdrawal, as stated in Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. By way of example, but not limited to, these exceptions include: customized products; products that can deteriorate or expire rapidly; CDs/DVDs of music or video, all types of software, computer components such as graphics cards, hard drives, CPUs, and motherboards, without their original packaging as sealed by the factory; products that are sealed for hygiene or health reasons and have been unsealed after delivery, such as kitchen utensils, pans, household items in general. All products that require direct contact with parts of the body, such as in-ear headphones, hair straighteners, epilators, or personal care products. Fixed installation products that have been modified for installation (ovens, countertops, microwaves, washing machines).

The provision of a service that the user may contract on this website is governed in the same manner. According to the same law, the right of withdrawal shall not apply when the service has been fully performed or has begun with the express consent of the consumer and user, along with their acknowledgment that once the contract has been fully performed by OUTLET PC, they will lose their right of withdrawal.

In any case, no refund will be made if the product has been used beyond mere opening, if the products are not in the same condition as when they were delivered, or if they have been damaged after delivery.

Likewise, the products must be returned using or including all their original packaging. In the case of computer-related items, the operating system must be in the same condition as received, preserving the partitions and original programs. Hard drives must be free of external content, as well as any type of configuration. The user must return the instructions and any other accompanying documents, along with a copy of the purchase invoice.

Small products must be returned packaged in a similar manner to how they were received, ensuring that the product cannot be easily identified. Larger products must be shipped in a way that the packaging cannot be opened, properly secured, and protected to prevent damage during transit.

OUTLET PC will not accept any product return that does not have its original packaging. If the original packaging is missing, the product will need to be sent to the manufacturer's official technical service.

Return of Defective Products or Incorrect Shipping

These cases include situations where the user considers that, at the time of delivery, the product does not conform to what was stipulated in the contract or purchase order. In such cases, the user must immediately contact OUTLET PC and inform them of the existing non-conformity (defect/error) through the same means or by using the contact information provided in the previous section (Right of Withdrawal).

The user will then be informed of how to proceed with the return of the products, and once returned, they will be examined, and the user will be informed within a reasonable period of time whether a refund or replacement is applicable.

The refund or replacement of the product will be carried out as soon as possible and, in any case, within 14 days from the date we send an email confirming the refund or replacement of the non-conforming item.

The amount paid for products that are returned due to a defect, when one truly exists, will be fully refunded, including delivery costs and any costs incurred by the user for the return. The refund will be made using the same payment method that the user used for the purchase.

In any case, the user will always have the rights recognized by the current legislation as a consumer and user.

Warranties

As a consumer and user, the user is entitled to warranties on the products they may acquire through this website, in the legally established terms for each type of product. Consequently, OUTLET PC is responsible for any lack of conformity that becomes apparent within two years from the delivery of the product, as offered by the brand, the manufacturer, or OUTLET PC (consult the point of sale where the product was purchased to know the warranty provided).

Products from liquidations: 2-year warranty directly from the manufacturer. If the manufacturer no longer exists, OUTLET PC will assume responsibility for the product warranty.

Products with aesthetic defects, damaged packaging, or refurbished: 1-year warranty, although in some cases a 2-year warranty may be provided even if the product is refurbished.

In this regard, the products are considered to be in conformity with the contract as long as they: conform to the description provided by OUTLET PC and possess the qualities presented therein; are suitable for the purposes for which products of the same type are normally used; and exhibit the usual quality and performance of a product of the same type that are fundamentally expected from it. When this is not the case with respect to the products delivered to the user, the user must proceed as indicated in the section "Return of Defective Products or Incorrect Shipping." However, some of the products sold on the website may present non-homogeneous characteristics, as they may derive from the type of material with which they were manufactured, and therefore, they will form part of the individual appearance of the product and will not be considered a defect.

9. LIMITATION OF LIABILITY

Unless otherwise provided by law, OUTLET PC shall not accept any liability for the following losses, regardless of their origin:

· any losses not attributable to any breach on its part;

· business losses (including loss of profits, revenue, contracts, anticipated savings, data, loss of goodwill, or unnecessary expenses incurred); or

· any other indirect losses that were not reasonably foreseeable by both parties at the time the sales contract for the products was formalized.

Similarly, OUTLET PC also limits its liability in the following cases:

· OUTLET PC applies all measures to ensure a faithful display of the product on the website; however, it shall not be held responsible for minimal differences or inaccuracies that may exist due to screen resolution issues or problems with the browser used, among others.

· OUTLET PC will act with the utmost diligence to make the product available to the company responsible for its transportation. However, it shall not be held responsible for damages arising from transportation failures, especially due to reasons such as strikes, roadblocks, or any other issues typical of the industry that result in delays, losses, or theft of the product.

· Technical failures that, due to fortuitous events or other reasons, prevent the normal operation of the internet service. Unavailability of the website due to maintenance reasons or others, preventing access to the service. OUTLET PC makes every effort to carry out the purchasing, payment, and shipping/delivery process; however, it is not responsible for causes beyond its control, such as force majeure or unforeseeable circumstances.

· OUTLET PC is not responsible, either directly or indirectly, for any of the services, information, content, statements, or expressions provided by payment service providers and reservation management companies used on the outlet-pc.es website. Each provider is responsible for their dealings with consumers, administration, and third parties.

· Regarding information on events and news, responsibility lies at all times with the sources of information for such events. The customer understands that OUTLET PC is merely an intermediary between them and the sources of information when it comes to documents, news, and events for which third parties are responsible.

· In general, OUTLET PC will not be held liable for any non-compliance or delay in compliance with any of the obligations assumed when such non-compliance or delay is due to events beyond its reasonable control, i.e., events of force majeure. In such cases, the obligations will be suspended for the duration of the force majeure event, and OUTLET PC will have an extension period to fulfill them equal to the duration of the force majeure event. OUTLET PC will make every reasonable effort to find a solution that allows it to fulfill its obligations despite the force majeure event.

10. INTELLECTUAL AND INDUSTRIAL PROPERTY

The website is protected by intellectual and industrial property rights. By way of example, but not limited to, the content, graphic design, source code, logos, texts, graphics, illustrations, photographs, and other elements appearing on the website are protected by intellectual and industrial property rights of OUTLET PC or their respective owners. Therefore, the user acknowledges that the reproduction, distribution, commercialization, transformation, and, in general, any form of exploitation, by any means, of all or part of the website constitutes an infringement of the intellectual and industrial property rights of OUTLET PC or the rights holder, unless the user has obtained prior express authorization.

Any use outside of OUTLET PC, including the reproduction, modification, distribution, transmission, republication, arrangement, or representation of any elements thereof, is strictly prohibited without the express written consent of OUTLET PC.

The user may not modify or use such intellectual and industrial property in a manner that would be detrimental to OUTLET PC.

OUTLET PC will claim damages and losses resulting from the unauthorized use by third parties of its intellectual and industrial property.

OUTLET PC does not grant any license or authorization for the use of its intellectual and industrial property rights or any other rights or property related to the website, services, or content.

11. WRITTEN COMMUNICATIONS AND NOTICES

By using this website, the user agrees that most of the communications with OUTLET PC will be electronic (email or notices posted on the website).

For contractual purposes, the user consents to the use of electronic means of communication and acknowledges that all contracts, notices, information, and other communications sent by OUTLET PC electronically comply with the legal requirements of being in writing. This condition does not affect the user's rights recognized by law.

The user may send notifications and/or communicate with OUTLET PC through the contact information provided in these Terms and Conditions and, if applicable, through the contact spaces on the website.

Likewise, unless otherwise specified, OUTLET PC may contact and/or notify the user via their email or the provided postal address.

12. WAIVER

No failure or delay by OUTLET PC to exercise a specific legal right or requirement or the failure of OUTLET PC to demand strict compliance by the user with any of their obligations shall constitute a waiver of other rights or actions arising from a contract or the Terms and Conditions, nor shall it relieve the user from fulfilling their obligations.

No waiver by OUTLET PC of any of these Terms and Conditions or of the rights or actions arising from a contract shall take effect unless it is expressly stated to be a waiver and is formalized and communicated to the user in writing.

13. SEVERABILITY

If any of these Terms and Conditions is declared null and void by a final resolution issued by a competent authority, the remaining clauses shall remain in force and unaffected by such declaration of nullity.

14. ENTIRE AGREEMENT

These Terms and Conditions, along with any document expressly referred to herein, constitute the entire agreement between the user and OUTLET PC regarding the subject matter of the sale and supersede any other agreement, oral or written, previously made by the same parties.

The user and OUTLET PC acknowledge that they have consented to enter into a contract without relying on any statements or promises made by the other party unless explicitly mentioned in these Terms and Conditions.

15. DATA PROTECTION

The personal information or data provided by the user to OUTLET PC during a transaction on the website will be processed in accordance with the provisions of the Privacy Policy (contained, if applicable, in the Legal Notice and General Terms of Sale). By accessing, browsing, and/or using the website, the user consents to the processing of such information and data and declares that all information or data provided is truthful.

16. APPLICABLE LAW AND JURISDICTION

Access, navigation, and/or use of this website and the purchase contracts for products through it shall be governed by Spanish law.

Any dispute, issue, or disagreement arising out of or in connection with access, navigation, and/or use of the website, or the interpretation and performance of these Terms and Conditions or the sales contracts between OUTLET PC and the user, shall be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.

17. COMPLAINTS AND CLAIMS

The user may submit complaints, claims, or any other comments they wish to make to OUTLET PC through the contact information provided at the beginning of these Terms and Conditions (General Information).

Furthermore, OUTLET PC has official complaint forms available to consumers and users, which they can request from OUTLET PC at any time using the contact information provided at the beginning of these Terms and Conditions (General Information).

If a dispute arises from this purchase contract between OUTLET PC and the user as a consumer, the user may request an out-of-court dispute resolution in accordance with Article 14(1) of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC.
